At Kilbey and Clarke we take the security of our clients’ personal information very seriously. We are licensed by the ICO to collect, process and retain clients’ information in accordance with the new General Data Protection Regulations. Here is our privacy statement which indicates what we do and do not do with your information.
Who are we?
We are Kilbey and Clarke, a business partnership consisting of Nigel Kilbey and Keith Clarke. Our business address is 5 Orchard Close, East Hanney, Oxfordshire OX12 0JD. We specialise in writing wills, Lasting Powers of Attorney and Trusts. We also are agents to sell Funeral Plans.
We have a data Protection Officer who can be contacted at that address or via email to firstname.lastname@example.org. Keith Clarke is the data protection officer.
What Information we collect about you.
We collect information such as name, address, phone numbers and email address either when you first contact us or during subsequent conversations and emails. We do not have cookies on our website and if this changes we will amend our policy and place alerts on our website. We do not garner any information about you by electronic means.
We collect other information from you that is necessary to write your wills, or other services we provide. It is possible in some rare circumstance that we also obtain information from a close relation but you will be made aware of this at the time, or we will be acting at your request.
Why we collect information about you and what we do with it
We collect information solely to carry out our agreement with you to provide your legal document(s).
We retain your contact details so that we may send you occasional newsletters (if you have given us your consent) or to remind you that you should perhaps review the terms of your will etc. We may also send you information about our products and services and any special offers there may be. We have a duty of care to all our clients to remind them from time to time that it may be appropriate for them to review the terms of their wills. We also need to ensure that your rights are met under Data Protection rules and regulations.
Who we share your information with
We will retain your information for as long as you are a client of ours unless you ask us to delete it. We will, however, retain all documents such as wills, Lasting Powers of Attorney and Trusts etc as long as they are valid documents.
Transferring information outside the EEA
We do not transfer your information to any third party anywhere with the exception of The Society of Will Writers.
Your rights and choices
Promotional material by email. You have the right to withdraw your consent to receiving such material by contacting us by phone, letter or email.
Access: You can request a copy of all the information we hold about you by contacting us.
Correction (Right of rectification): We always want the most up to date information so please notify us if any information needs to be rectified.
Deletion (Right to be forgotten) In some circumstances including where we are relying on your consent to use your data you have a right to request us to delete your information.
Complain: You have a right to complain to the Information Commissioner’s Office if you feel we have used your information in an unlawful manner. Please see their website

Keeping your information secure
We take the safety and security of your personal information extremely seriously. We have implemented policies to ensure that all IT equipment is password protected and that any physical documentation is securely locked away when unattended. We will keep these policies under constant review.
This policy comes into effect on 25 May 2018. Any alterations will be clearly indicated on our website when they occur.
